FAQ

How is annual leave accrued?

In the first year, employees earn 1 day per month of full attendance, up to 11 days. From the 1-year mark onward, leave starts at 15 days and increases by 1 day every 2 additional years of service, up to a maximum of 25 days.

What is unused leave pay?

Under the Korean Labor Standards Act, employers must compensate any unused annual leave days at the employee's ordinary daily wage rate.

When does annual leave expire in Korea?

Annual leave expires 1 year after it accrues if not used. However, if an employer properly completes the legally required leave encouragement process (written notice twice), they are exempt from paying unused leave compensation. Without the proper encouragement procedures, employees can claim unused leave pay even after the expiry date.

How is annual leave calculated during the first year of employment?

In the first year, employees earn 1 day of leave for each month of full attendance, up to 11 days. Upon completing 1 full year of service, 15 days are granted — but leave days taken during the first year are deducted from this 15-day entitlement. For example, if you used all 11 days in year 1, you would have 4 days remaining (15 − 11) at the 1-year mark.

What is ordinary wage (통상임금) for unused leave pay calculation?

Ordinary wage is the base pay regularly, uniformly, and fixedly provided to employees — including base salary and fixed allowances. Meal and transportation allowances may qualify as ordinary wage if paid uniformly to all employees regardless of performance. Unused leave compensation is calculated as: ordinary daily wage × number of unused leave days.

How does the annual leave usage promotion system work in Korea?

Under the Korean Labor Standards Act, employers must notify employees in writing of their unused leave days no later than 6 months before those days expire, and prompt them to designate when to use the leave. If an employee fails to specify a time, the employer must issue a second written notice designating the leave period. If both steps are completed lawfully, the employer is exempt from paying unused leave compensation. If either step is missing, the employee may claim unused leave pay.

How many annual leave days are added for each additional year of service?

Under the Labor Standards Act, employees with 1 or more years of service start at 15 days, then gain 1 additional day every 2 years from the 3rd year onward. For example, years 3–4 give 16 days, years 5–6 give 17 days, and the count caps at a maximum of 25 days from 21 years onward. Moving the tenure slider in 2-year increments lets you see the 1-day increase pattern directly. You can also confirm on the slider that the count stops growing at 25 days even when tenure goes higher.
